Derek is an accomplished Barrister, having been called to the Bar in 1991. He holds accreditation from the English Bar Council for Public Access, enabling him to engage directly with clients. Derek's professional affiliations include being a Fellow of the Chartered Institute of Taxation (CIOT), serving as the Chairman of the Edinburgh Tax Network and CIOT Edinburgh & Lothians. Additionally, he has previously held a position as a Scottish committee member of the Society of Trust & Estate Practitioners.
In his legal practice, Derek specializes in high-end trust and estate work, encompassing both Scots and English jurisdictions. While his primary focus is on matters related to trusts, estates, and taxation, he has also advised and appeared in various tax cases, with a particular emphasis on indirect tax matters. Derek's expertise extends to Family Investment Company IHT planning, an area in which he has recently spoken on behalf of CIOT. He frequently handles the drafting and revision of trust documentation for the purposes of IHT planning, often providing precedent styles for prominent firms in this field.
Derek's involvement in the legal sphere extends to advising and litigating on matters pertaining to pensions, spanning both Scots and English jurisdictions. He possesses considerable knowledge in areas such as Imperial duty, fairness, and estoppel by convention. Notably, Derek has gained extensive experience dealing with cases involving MFK Underwriting/Fayed's legitimate expectations arising from HMRC Guidance and dealings. He has published extensively on these topics and previously served as a member of the Editorial Board and Scottish Editor of Foster's Inheritance Tax.
